What types of personal information does Everlink typically collect from its clients?
In the course of providing services to our clients, Everlink typically collects information relating to the client’s directors, officers, shareholders, employees, customers, business partners and other related parties and individuals. Specifically, this may include personal information such as names, occupation, phone numbers, email addresses, IP addresses, physical addresses, billing and account information, cardholder information and other information relevant to the products or services being provided to the client.


Why does Everlink collect, use and disclose its clients’ personal information?

Everlink collects, uses and discloses personal information for the primary purpose of providing integrated payment processing services and other related products and services to its clients. In general, this may include the following activities:

  • to perform services, functions and obligations in accordance with Everlink’s agreements with its clients, and to exercise Everlink’s rights under those agreements;
  • to initiate, develop and manage client relationships by communicating with existing and prospective clients and informing them of the products and services which Everlink provides, offers or plans to offer to them, as well as any other relevant business information which may be of interest to them;
  • to manage and develop Everlink’s business and operations; and
  • to comply with all legal, accounting and security requirements in accordance with any laws, regulations, rules, industry standards and other requirements which Everlink is subject to.

How does Everlink collect personal information from its clients and obtain their consent to collect, use and disclose their personal information?
Everlink collects personal information that is provided to us primarily by our clients in accordance with Everlink’s agreements with those clients.

Everlink also provides its clients with information about Everlink and Everlink’s products and services through a wide variety of resources, including Everlink’s website, press releases, newsletters, and other communications. For its own internal business purposes, Everlink may also collect information, which can be obtained by observing and analyzing our clients’ use of these resources.

In the case where a client or any other person provides Everlink with personal information relating to a third party, Everlink will require that the client or other person obtain the third party’s consent to the collection, use and distribution of the personal information before disclosing it to Everlink. By providing Everlink with personal information for any reason, you are also consenting to our reasonable collection, use and distribution of such personal information for that reason (unless otherwise stated in an agreement between you and Everlink).

 

Who might Everlink provide personal information to in the course of providing services to its clients?
Everlink may use various third party suppliers, service providers and partners in order to provide services to its clients. The personal information which Everlink collects from its clients may be collected, used and stored by such third parties on Everlink’s behalf for the purpose of providing Everlink with services such as transaction acquiring, routing and processing services, disaster recovery and business continuity services, billing and accounting services and other related service, which are integral to Everlink’s business and operations. Everlink employs a variety of physical, technological and contractual measures in order to help ensure that the personal information is treated securely at all times.

 

Where does Everlink store its clients’ personal information?
Everlink and its third party suppliers, service providers and partners may process data, including personal information, outside of Canada. A primary example of this is Everlink’s use of its affiliate’s data centre in the USA for storing back-up transaction processing data for disaster recovery and business continuity purposes.

 

What resources and choices are available to our clients should they have any questions or concerns about this Privacy Policy or Everlink’s business practices in relation to personal information?
Everlink will use reasonable efforts to ensure that the personal information which is collects is kept up-to-date and remains accurate while in its possession. Everlink also respects its clients’ rights to access, correct or amend their own personal information, and our own obligations to address any issues which our clients may have, in accordance Canadian privacy legislation.
